Savković: In the Sveti Stefan arbitration, I was an independent expert witness, not a lawyer

The Dean of the Faculty of Law in Podgorica, Vladimir Savković, has rejected the claims of PES MP Vasilije Čarapić about his controversial involvement in the Sveti Stefan arbitration, stating that he participated in the proceedings solely as an independent expert witness. He stressed that his role was not to represent any party, but to provide an impartial expert opinion to the arbitration tribunal, in accordance with the rules and professional ethics.

Čarapić previously announced on Facebook that Savković had earned 120,000 euros from a law firm that represented the investor in order to, as he stated, "fight against the state."

In his response, Professor Savković points out that well before his election to the position of dean, he was engaged by one of the parties to the proceedings to act as an independent expert witness, exclusively for the needs of the arbitration tribunal, to prepare an impartial expert report on certain legal issues in the field of Montenegrin law and to testify orally about the same.

According to him, in this and similar arbitration proceedings, his obligation and that of other expert witnesses could not and should not be to represent or "fight" for the interests of any party to the proceedings.

On the contrary, as he says, it is expressly prohibited by the rules of the tribunal in London, as well as any other institutional arbitration in the world.

It is recalled that the obligation of an expert witness is absolute professionalism and impartial assistance to the arbitral tribunal in reaching a just resolution of the dispute.

"In accordance with my personal and professional ethics, I have tried to make a full contribution to this, which means that the report I prepared for the needs of the arbitration tribunal on the legal issues raised would be the same regardless of which party in the dispute hired me to write it. At the same time, for the sake of the Montenegrin public, I emphasize that the logic of MP Čarapić, according to which Montenegrin legal experts and the academic community should, for patriotic reasons, deny this type of cooperation to foreign investors in Montenegro, is absolutely wrong and extremely detrimental to the efforts of our country to create a favorable and credible investment environment," Savković points out.

In his opinion, patriotism and professional ethics are something entirely different.

“Patriotizam i profesionalna etika su da se svima u Crnoj Gori, pa i stranim investitorima, omogući jednak pristup procesnim mogućnostima i pravdi uopšte”, poručuje profesor Savković.
