"Current proposals and draft laws on amendments to the Law on the Constitutional Court and the Law on the Judicial Council and Judges provide that the function of judges will cease at the age of 66 due to fulfilling the retirement requirements, while no changes have been proposed for state prosecutors, i.e. their function will continue to cease due to retirement at the age of 65, in accordance with the Law on Pension and Disability Insurance," HRA states.
HRA believes that there is no justified reason for such a distinction. Holders of judicial and constitutional court positions must not be in a less favourable position than other employees, and the lack of harmonisation of regulations is particularly worrying.
HRA specifically requested that the Ministry of Justice propose amendments that would introduce a 67-year age limit for judges of the Constitutional Court, for judges of regular courts, and for state prosecutors.
