Drunk driver agrees to four years in prison for pedestrian's death

Miloš Jovetić (31) from Mrkonjić, who is accused of driving while severely intoxicated with about four per mille of alcohol in his blood and hitting and killing pedestrian Daliborka Ožegović (51), agreed to a four-year prison sentence.

Jovetić reached a plea agreement with Banja Luka District Prosecutor Bojan Topić. The sentence includes time spent in custody for one month and 13 days. 

In addition to prison, the driver's license will be revoked for two years and the costs of the criminal proceedings will be paid.

The Judicial Council of the Banja Luka District Court, chaired by Judge Zorica Baroš, accepted the agreement. 

The verdict in this case is scheduled for Monday, March 30th. 

Mitigating and aggravating circumstances

According to Prosecutor Topić, the defendant's confession contributed to the efficiency and economy of the proceedings.

"As mitigating circumstances, we considered the defendant's lack of criminal record and expressed remorse. Aggravating circumstances include leaving the scene of the accident and driving under the influence of alcohol, while he had previously been convicted of a misdemeanor," said Topić.

The defendant's defense attorney, Gordana Mitrović, pointed out that the accident had a severe impact on her client, whose life changed overnight.

As she added, after the accident he lost his job and lives with his father, a war veteran, and his grandmother. 

She also stated that the death of his mother before the accident had greatly affected him. Defendant Jovetić stated that he agreed with the lawyer and apologized to the victim's family. 

The position of the victim's family

The victim's husband, Ranko Ožegović, emphasized that the family is not seeking compensation for damages and that they are not opposed to the agreement with the prosecutor's office.

As a reminder, the fatal accident occurred on December 18, 2024 on the Prnjavor - Klašnice road. 

Jovetić, driving an Alfa Romeo with 4.09 g/kg of alcohol in his system, hit Daliborka Ožegović, who was walking on the shoulder, and the woman died at the scene.

The accused, as stated in the indictment, was aware that he was not capable of driving a car safely. 

He crossed onto the right shoulder, where he hit a pedestrian, and her body was thrown onto the car.

The woman hit her head on the windshield and fell into a roadside ditch, where she was killed.

Jovetić fled the scene of the accident and continued on his way towards Derventa, then parked on the street where he lives. 

However, he was arrested the same day.
